  Under Pennsylvania law, special rules have been developed for accidents involving children.  These rules are designed to protect a child and his or her interest in a case.   A child under the age of eighteen may be entitled to bring an action for personal injuries even though more than two years has passed since the date of the accident. Generally, a child has up to his or her eighteenth birthday in which to bring an action for personal injuries. This general rule may not apply in all cases.  Regardless of the age of the child when the injury occurs, valuable evidence may be lost unless prompt investigation is made.  Whenever a child is seriously injured you should immediately contact the CARDENAS LAW FIRM as soon as possible to know your rights and especially before you speak to an insurance adjuster.  Child injury cases may involve all kinds of injuries including the following more common types of cases:

COURT APPROVAL OF CASES
  Court approval is required in Pennsylvania for children entitled to personal injury settlements.   A hearing is held to determine that the settlement is reasonable.  After approved expenses are paid, the net settlement funds are placed in a restricted account on behalf of the minor.  The funds can be released to the minor when he or she turns eighteen.
