SEPARATION DIVORCE

You can get a "separation" divorce without your spouse's signature required.
You must be separated for at least two years.  

You can get a no-fault divorce if you have been separated for more than 2 years. Our fee includes all court costs and a full service divorce process. This is not a kit. Your divorce will be done by a lawyer

If in addition to a divorce, you need to have an agreement prepared regarding other issues such as alimony, custody, division of debt or division of marital property, we can help you with an additional service where we would prepare a Marriage Settlement Agreement for you based on the terms that you and your spouse have agreement on.  Please call us to discuss in detail how this service is provided in conjunction with your divorce proceeding.

HOW THE SEPARATION DIVORCE WORKS.

  • STEP ONE: First, remember that this type of divorce service is only for cases where the parties have been separated for two years or more.  Also, you or your spouse must live in Pennsylvania. 

  • STEP TWO: The fastest way to get your divorce started is to print out the DIVORCE INFORMATION WORKSHEET AND VERIFICATION from your choice of formats below.

    Do you want the documents mailed to you instead?

    Follow the instructions included in the documents you downloaded.  Then, mail the Worksheet and all the signed documents along with your check or money order for $325.00 to the address below.  You can also call our office and we can take your payment over the phone using a VISA or MASTERCARD card.

  • STEP THREE: As soon as we get your Worksheet, verification and fee, an attorney will call you to confirm all the information you mailed us and answer any questions you may have. You should be prepared for this consultation by having all your questions written down.

  • STEP FOUR: The divorce will then be filed.  Your spouse will receive a copy of the Divorce Complaint and Plaintiff's Affidavit by certified mail.  Your spouse must pick up and sign for his or her registered mail for the divorce process to continue.**  You will receive your copy of the these documents after they are filed.   

  • STEP FIVE: By law, we have to wait 20 days from the date your spouse received the complaint before we can then send him or her a Counter-Affidavit and a Notice of Intend.  These documents will be mail to them.

  • STEP SIX: If your spouse does not respond to the documents sent after 20 additional days from the time they get the Counter-Affidavit and Notice of Intend, we will then finalize the divorce and you will get a certified copy of the Divorce Decree once it is issued by the court.

** Additional fees would only apply if there is a problem with serving your spouse with the complaint, or if your spouse fights the divorce in any way.
