Perhaps there is nothing as tragic as the death of a loved one caused by the actions of another.  Wrongful death is a term used to describe the type of lawsuits brought by the surviving relatives of a deceased person against the person who caused the death to occur.  The wrongful death lawsuit is for the loss of that persons love, companionship, solace, guidance, financial and emotional support.  The idea is that the survivors have been injured by the absence of the person who died.  Determining the amount of damages requires consideration of what probably would have occurred in the future.  A wrongful death action is separate from the lawsuit that may be brought on behalf of the deceased person by his or her estate for damages resulting from injuries to the deceased.  For procedural purposes, these actions are typically combined into one lawsuit.

The wrongful act may be:

  • a negligent or careless act such as careless driving
  • a reckless act or
  • an intentional act such as a deliberate murder

The family of the deceased may be able to recover for:

  • Medical Expenses
  • Pain and Suffering Experienced by the Survivors
  • Punitive Damages (under certain circumstances)
  • Loss of Consortium Damages
  • Loss of Expected Income by the Deceased

The elements of compensation or the determination of amount of damages in a wrongful death case  can be very complex.  To fully understand them, you can contact us at the Cardenas Law Firm, P.C. and speak with a lawyer about the specifics.  These type death cases are typically handled on a contingency basis, which means there are no fees or costs incurred unless and until a recovery is obtained.
Under the often difficult and emotional circumstances of these cases, the Cardenas Law Firm, P.C. strives to be sensitive to the loss our clients have suffered while working vigorously to help them recover what the law allows.
